Terms & Conditions
Last updated: 7 AUg 2026
These Terms & Conditions (“Terms”) govern the provision of on-site machining, metrology, and engineering services by Dynamics Engineering (“we,” “us,” “our”) to any client requesting or receiving such services (“you,” “Client”). By requesting a quote, placing an order, or accepting our services, you agree to be bound by these Terms.
1. Services
Dynamics Engineering provides on-site and workshop-based machining, metrology, inspection, and engineering services as described on our website or in a specific written quotation. The exact scope of work for any engagement is defined in the quotation, work order, or purchase order agreed between the parties, and these Terms apply in addition to, not in place of, that scope.
We reserve the right to decline any job, at our discretion, following a site assessment, if the work falls outside our technical capability, safety standards, or equipment scope.
2. Quotations & Site Assessments
Quotations provided prior to a site assessment are estimates based on the information supplied by the Client and are subject to revision once our engineers have inspected the equipment or component in person. Final pricing is confirmed in writing before work begins.
Quotations are valid for [30] days from the date of issue unless otherwise stated. We reserve the right to revise pricing after this period to reflect changes in material, labour, or travel costs.
3. Client Responsibilities
The Client is responsible for:
- Providing safe, lawful access to the site and equipment to be worked on, including any required permits or permissions.
- Ensuring the equipment is isolated, de-energized, and safe to work on where required, or clearly communicating any hazards to our team in advance.
- Providing accurate drawings, specifications, or samples where the job depends on them.
- Informing us of any site-specific safety requirements, inductions, or compliance standards before work begins.
Delays or additional costs arising from inaccurate information, restricted access, or unsafe site conditions not disclosed in advance may be billed separately.
4. Payment Terms
Unless otherwise agreed in writing, payment terms are [50% advance, balance on completion / Net 30 from invoice date — confirm actual terms]. Invoices are due within the period stated on the invoice. Late payments may be subject to interest at [X%] per month on the outstanding balance, in accordance with applicable law.
We reserve the right to suspend work on any job, including work in progress, if payment terms are not met.
5. Warranty
We warrant that work performed will conform to the agreed specification and be carried out with reasonable skill and care, in line with standard industry practice. Where a specific tolerance or standard is agreed in writing, we warrant the work to that standard.
This warranty does not cover: pre-existing damage or wear not part of the agreed scope, failure caused by factors outside our control after work is completed (including misuse, lack of maintenance, or unrelated component failure), or work carried out based on incorrect information supplied by the Client.
Warranty claims must be raised in writing within [X days] of job completion, with supporting evidence of the defect.
6. Liability & Limitation
To the fullest extent permitted by law, our total liability for any claim arising from or related to our services, whether in contract, tort, or otherwise, is limited to the value of the invoice for the specific job giving rise to the claim.
We are not liable for indirect or consequential losses, including but not limited to lost production, lost profit, or downtime costs, except where such exclusion is not permitted by law.
Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded under applicable law.
7. Cancellation
Either party may cancel a scheduled job with [X days/hours] written notice. Cancellations made after our team has been mobilised to site, or after materials/equipment have been arranged specifically for the job, may be subject to a cancellation charge to cover costs already incurred.
8. Intellectual Property
Drawings, CAD models, and reports produced as part of reverse engineering or design work remain our intellectual property until full payment is received, at which point ownership transfers to the Client for the purpose of that job, unless otherwise agreed in writing.
We may retain copies of drawings and inspection reports for our own quality and reference records.
9. Confidentiality
Both parties agree to keep confidential any technical, commercial, or operational information shared in the course of the engagement, and not to disclose it to third parties without written consent, except where required by law.
10. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms or our services are subject to the exclusive jurisdiction of the courts of Pune, Maharashtra.
11. Changes to These Terms
We may update these Terms from time to time. The version in effect at the time a quotation is issued applies to that engagement.
